1. Pricing and Payment

• Pricing: Unless stated otherwise, all prices are F.O.B. Livonia, Michigan. Prices, discounts, and specifications are subject to change without notice unless a deposit has been secured. MoonwalkUSA is not responsible for typographical or clerical errors.
• Standard Orders: Units are sold on a first-come, first-served basis. A minimum deposit of 25% is required to guarantee the next available unit.
• Custom Orders: A 60% deposit is required for custom-made items, including name tags, custom designs, and non-standard colors.
• Final Payment: All balances must be paid within 7 days of the unit becoming available. Orders must be paid in full in US Dollars prior to shipping.
• Sales Tax: Prices do not include sales tax. Buyers are responsible for applicable taxes and agree to hold MoonwalkUSA harmless from any tax claims or penalties.

2. Shipping and Delivery

• Requirements: Full payment and complete shipping information must be received before an order ships. If a preferred shipping method is not specified, MoonwalkUSA will select one at our discretion.
• Liability and Costs: Buyers are responsible for all shipping costs, including insurance and customs. Risk of loss or damage transfers to the buyer once goods are handed to the carrier.
• Delays: MoonwalkUSA will make every effort to meet delivery dates but is not liable for delays or damages arising from causes beyond our control.
• Defects: Any manufacturing defects must be reported in writing within 10 days from the date the freight is picked up.

3. Returns and Cancellations

• 7-Day Window: Buyers have 7 days from receiving an item to report defects, damage, or request a return authorization. Defective items will be repaired locally or at an assigned facility.
• Standard Returns: Authorized returns must be in new, unused condition and in the original packaging. Buyers are responsible for shipping costs, payment processing fees, a 15% restocking fee, and any repairs needed to return the item to a like-new condition.
• Custom Orders: We do not accept returns for any custom-manufactured products.
• Cancellations: If an order is changed or canceled after payment processing, MoonwalkUSA reserves the right to withhold initial payments to cover production readjustments and associated costs.

4. Limited Warranty

MoonwalkUSA warrants that products will be fit for their intended purpose and free from material defects in workmanship for the original buyer. Warranties include:

• 1 Year: Commercial Grade Inflatables and dunk tanks.
• 90 Days: Sumo equipment and Residential Inflatables.
• 30 Days: Hand trucks and accessories.
• No Warranty / Sold AS-IS: Zippers, netting, mesh, Velcro, basketball hoops/nets, gloves, joust poles and pedestals, bungee cords and vests, Velcro suits, tarps, sandbags, storage bags, wear covers (entrance covers, mats, slide steps), tents, zorb balls, water balls, chairs, and all clearance items.
• Blower Warranty: Handled directly by the blower manufacturer.

Warranty Void Conditions: Mold or mildew voids the warranty. Ordinary wear and tear is expected. Misuse, improper handling, lack of maintenance, or failure to use proper stakes and tie-downs will invalidate the warranty. Buyers are responsible for shipping costs related to warranty repairs. No warranty is made regarding exact color matching.

5. General Terms and Liability

• Insurance Requirement: Buyers agree to carry general liability insurance with coverage limits of no less than $1,000,000 in connection with the use or rental of MoonwalkUSA products.
• Copyrights: All logos, artwork, product names, and designs are the sole property of MoonwalkUSA. Unauthorized reproduction is a copyright infringement. MoonwalkUSA makes no warranty against third-party infringement claims.
• Product Tolerances: Weights, colors, and dimensions stated in our literature are approximate and fall within industry tolerances. We reserve the right to discontinue or improve product designs without obligation to update previously sold units.
• Limitation of Liability: Under no circumstances shall MoonwalkUSA be liable for any incidental, consequential, punitive, or special damages arising from order performance, delays, or the use of our goods.
• Governing Law: Transactions are governed by the laws of the State of Michigan. Any litigation must take place in the Wayne County Superior Court or the United States District Court for Michigan, and the prevailing party is entitled to recover reasonable attorneys' fees.
